These Terms & Conditions "Terms" govern your use of dominiquelondon.es (“the Website”) and any purchases you make from Dominique London NV (“Dominique London”, “we”, “us”, “our”). By accessing the Website or placing an order, you agree to be bound by these Terms.

2. ELIGIBILITY AND AGE VERIFICATION

1.1 We do not market or sell tobacco products to anyone under 18 years of age (or the higher minimum age in your jurisdiction).

2.2 By using the Website or placing an order, you confirm that you are of legal age where you reside and consent to age-verification checks.

1.3 If you are not of legal age, you must not use the Website or purchase products.

3. HEALTH INFORMATION

3.1 Tobacco use is harmful to health.

3.2 You acknowledge that the use of tobacco products is at your own risk. To the fullest extent permitted by law, we accept no liability for any health consequences arising from tobacco use.

4. PRODUCTS, INFORMATION AND CONTRACT FORMATION

4.1 Product descriptions, packaging images and specifications are provided for guidance only and may vary from the latest presentation.

4.2 All products and prices displayed on the Website are an invitation to treat, not a binding offer.

4.3 After checkout, you will receive an automated order acknowledgement. This is not an order confirmation.

4.4 A binding contract is formed only when we confirm availability and send an order confirmation or dispatch notification.

4.5 We may refuse or cancel an order for reasons including unavailability, pricing errors, incomplete information or suspected fraud.

5. PRICES, CURRENCY AND TAXES

5.1 Prices are listed in Euros (€) and exclude delivery charges unless otherwise stated.

5.2 If there is a pricing error discovered prior to dispatch, we may cancel the order and refund any amounts paid.

5.3 Customers paying from non-Euro accounts are responsible for any currency conversion fees applied by their payment provider.

6. PAYMENT AND AUTHORISATION

6.1 By placing an order, you confirm that:

  • all payment information is accurate;
  • you are authorised to use the payment method;
  • you agree to pay all charges including product prices, shipping costs and any relevant taxes or import duties.

6.2 Additional identity verification may be required for fraud prevention.

5.3 Your payment method may be charged at the time of order submission.

6.4 Payments are processed securely by approved third-party payment providers. We do not store or have access to full card details.

7. SHIPPING, DELIVERY TIMES AND RISK

6.1 Products are generally shipped in original manufacturer packaging, including bands where applicable.

7.2 Estimated (non-guaranteed) delivery times:

  • Canary Islands / Spain: approx. 2–4 business days
  • Rest of world: approx. 15–20 business days

7.3 Delivery times depend on postal and customs services and may vary.

7.3 Risk of loss passes to you upon delivery or first attempted delivery to the address you provided.

8. CUSTOMS, DUTIES AND IMPORT COMPLIANCE

8.1 You are responsible for ensuring that the importation of tobacco products is legal in your country or region.

8.2 You are responsible for all customs fees, duties, taxes, brokerage charges and delays caused by customs inspections.

8.3 You confirm that you understand your local rules before ordering.

9. DELIVERY GUARANTEE AND EXCEPTIONS

9.1 If a shipment is confirmed lost by the carrier, we will reship your order or issue a refund.

8.2 Delivery guarantee does not apply if non-delivery results from:

  • incorrect or incomplete addresses;
  • failure to update address information;
  • multiple failed delivery attempts;
  • tracking marked as “delivered”;
  • customs seizure or refusal;
  • any factors within your control.

9.3 If products are returned to us in good condition due to non-delivery, you may request a refund subject to a 20% administrative fee, plus any shipping costs and charges incurred.

10. UNDELIVERED ORDERS — NOTIFICATION PERIOD

If your order does not arrive, you must notify us within 30 days from the dispatch date.

After this period, we cannot file a claim with the carrier and cannot be held responsible for non-delivery.

11. CANCELLATIONS, RETURNS AND RESTOCKING

11.1 You may return unused items in their original packaging within 14 days of receipt for a refund or credit, excluding delivery costs.

11.2 All approved returns are subject to a 10% administrative fee, plus shipping costs, unless goods are faulty or misdescribed.

11.3 Return shipping costs are your responsibility unless the items are faulty or substitutes were sent.

11.4 The return policy does not apply where damage results from misuse, negligence, alteration or improper handling.

11.5 Your statutory rights under EU and Spanish consumer law remain unaffected.

11.6 Returns must be sent to the Spanish address listed in Section 1 unless we advise otherwise.

12. PRODUCT IMAGERY AND VARIATIONS

12.1 Packaging may change from the images displayed.

12.2 Minor presentation differences do not constitute misdescription where the correct brand, line, vitola and quantity are supplied.

13. WEBSITE USE

13.1 Website materials may be used for personal, non-commercial purposes only.

13.2 You may not:

  • reproduce or distribute Website content without approval;
  • create a database of Website material;
  • remove copyright notices;
  • upload harmful or illegal content;
  • interfere with Website functionality or introduce malware.

13.3 All use of the Website is at your own risk.

14. ENTIRE AGREEMENT AND CHANGES

These Terms, along with our Privacy Policy and Cookie Policy, form the entire agreement between you and Dominique London.

We may update the Terms at any time by posting a revised version on the Website.

15. LIMITATION OF LIABILITY

15.1 Our total liability in connection with any order is limited to the amount paid for the products, including the original delivery cost where applicable.

15.2 We are not liable for indirect or consequential loss, including loss of income, profit, goodwill or data.

15.3 Nothing in these Terms excludes any liability that cannot be excluded under applicable Spanish or EU law.

16. COMPLAINTS

If you have a complaint, contact us at info@dominiquelondon.com, including your order number and details.

16.2 We will acknowledge your complaint within 3 business days and aim to resolve it within 7 business days.

17. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of Spain.

You agree to the exclusive jurisdiction of the courts of Santa Cruz de Tenerife, without prejudice to mandatory EU consumer protection rights applicable in your country of residence.
